Criminal defense can focus on rehabilitation in juvenile crime

Violence is a significant part of Louisiana’s landscape. Video games that are pervasive among youth and the proliferation of guns may contribute to the increase in crimes allegedly committed by juveniles and the need for compassion in their criminal defense. In a recent case in New Orleans, a 12-year-old boy has been detained following an apparent shooting at his home. The boy’s mother is said to have suffered a gunshot wound to the head. She was rushed to a hospital by first responders who had responded to an emergency call. It was not clear who made the call. The woman is in the hospital and is said to be in critical condition.

At the time of the shooting, it is believed that the boy and his 2-year-old sister were in the home. Officers obtained a warrant to search the home following the shooting and reportedly found a weapon and a single casing in the boy’s bedroom. The boy was charged with attempted second-degree murder. No other details are known at this time.

When a child is involved in a crime, it can be said there are two victims. The juvenile who is reportedly involved is at risk of having his or her life derailed by the incident. A child who is accused in Louisiana is presumed innocent until and unless proven guilty. In the event a child is adjudicated delinquent in juvenile court, the focus should be on rehabilitation and giving the child a chance at a normal and productive life.
